Registration

The parties seeking to resolve the differences of opinion through BAPMI's Binding Opinion must submit in writing a registration of petition for BAPMI's Binding Opinion, to the attention of BAPMI's Chairman, and addressed to BAPMI. The petition must be filed jointly by both parties, and it must not by one party alone.

Contents of the Petition:
A Petition for Binding Opinion to BAPMI must include the following information:

  1. an agreement of the parties to appoint and ask BAPMI to provide a Binding Opinion with respect to the differences of opinion they have (a Binding Opinion Agreement);
  2. a detailed description of the dispute or differences of opinion;
  3. opinions desired by each party;
  4. an agreement and/or any relevant documents of each party;
  5. an assertion that all parties will be bound by and will execute BAPMI's Binding Opinion.

Verification of the Petition:
In respect of the Petition for Binding Opinion, BAPMI's Management will examine:

  1. whether the petition has meet any administrative requirements;
  2. whether the parties have had an agreement that the differences of opinion they have will be resolved through BAPMI's Binding Opinion;
  3. whether the differences of opinion brought are about civil issues in the field of or with respect to Capital Market; and
  4. whether the parties making such petition have paid the registration fee.

When the petition meets the above requirements, BAPMI's Management will provide the parties with a notice no later than 7 days after the registration of petition is accepted, and subsequently BAPMI and the parties agree on the fee of such Binding Opinion before continuing to the next stage (examination).
