Ethics Tribunal

The Honorary Council receives, examines and decides any complaints regarding any alleged violations of the Code of Conduct committed by any of BAPMI's Mediators/ Adjudicators/ Arbitrators as the first and last instances. Complaints may be submitted by BAPMI's Management, any of the disputing parties or other interested parties. Hearing is conducted by the Honorary Council through an Ethics Tribunal to summon, and hear testimony of, the complaining party and complained party.

The decision will be made by the Honorary Council by consensus or majority voting no later than 30 working days after the hearing. The decision must state any considerations on which it is based, and refer to the articles of the Code of Conduct of which the violation is committed. Immediately after receiving a copy of the Honorary Council's decision, the Management shall enforce such decision and submit a report to all BAPMI's Members and Chairman of the Financial Services Authority (FSA/OJK) regarding such decision and any actions taken.

When relevant Mediator/ Adjudicator/ Arbitrator of BAPMI is proved to have violated any of the Code of Conduct of Mediators/ Adjudicators/ Arbitrators, the sanctions or penalties can be:

  1. reprimand, both oral and written;
  2. written warning;
  3. suspension as BAPMI's Mediator/ Adjudicator/ Arbitrator;
  4. termination as BAPMI's Mediator/ Adjudicator/ Arbitrator.
