Guidelines for Conflict of Interest

Provisions regarding conflict of interest are regulated in BAPMI's Rules regarding Rules and Procedures of Binding Opinion, BAPMI's Rules regarding Rules and Procedures of Mediation, BAPMI's Rules regarding Rules and Procedures of Adjudication, BAPMI's Rules regarding Rules and Procedures of Arbitration. These requirements must be complied with by the Management, Mediators/ Adjudicators/ Arbitrators and other BAPMI personnel involved in the settlement process of a case in BAPMI.

Special for BAPMI's Mediators/ Adjudicators/ Arbitrators who will handle or is handling a case in BAPMI, BAPMI' rules also regulate guidelines for Conflict of Interest as criteria and standards for determining whether such Mediators/ Adjudicators/ Arbitrators of BAPMI are permitted or prohibited to be appointed as Mediators/ Adjudicators/ Arbitrators in a certain case in BAPMI. When any of BAPMI's Mediators/ Adjudicators/ Arbitrators who handle a case is found to be in violation of the guidelines for Conflict of Interest, he should resign from the case, or the disputing parties may request to BAPMI's Management for replacement.
