Scope of Services

BAPMI provides dispute settlement services upon request of the disputing parties through out-of-court dispute settlement mechanisms. However, not all disputes can be settled through BAPMI. Disputes that can be settled by BAPMI must meet the following requirements:

  1. only civil disputes arising between the disputing parties in the field of or in connection with Capital Market;
  2. an agreement between the disputing parties is made that the dispute will be settled through BAPMI;
  3. a written request (case registration) by the disputing parties is made to BAPMI;
  4. the dispute is not within the scope of criminal law or administrative law.

BAPMI provides 4 types of out-of-court dispute settlement services to be chosen by the disputing parties:

  1. Binding Opinion
  2. Mediation
  3. Adjudication
  4. Arbitration

In performing its function as an alternative dispute resolution institution, BAPMI ensures its independency and impartiality. Therefore, no one is allowed by BAPMI to act as a Mediator/ Adjudicator/ Arbitrator over a dispute when the person has a conflict of interest with the case handled or with one of the disputing parties or their attorneys. When a conflict of interest comes into the knowledge later, the Mediator/ Adjudicator/ Arbitrator should be replaced by another having no conflict of interest.
